Survdd Marketplace Terms

These Terms of Use (“Terms”) govern access to and use of Survdd, including its website, web application, customer accounts, vendor tools, ordering features, payment features, and related services (the “Platform”). By creating an account or using the Platform, you agree to these Terms and the Privacy Policy. Vendors also agree to the Survdd Vendor Agreement.

1. Marketplace role

Survdd provides technology that helps customers discover independent Food Trucks and eligible Home-Based Food Vendors, view menus and schedules, place orders, process payments, and communicate about transactions. Unless Survdd expressly states otherwise, the food is prepared, sold, represented, and fulfilled by the vendor—not by Survdd. Vendors are independent businesses.

2. Eligibility and accounts

You must be at least 18 years old to create an account. You must provide accurate information, protect your credentials, and promptly update inaccurate information. You may not impersonate another person, use another person’s account without authorization, or create accounts for fraud, abuse, review manipulation, or circumvention of restrictions. Survdd may restrict, disable, or remove accounts to enforce these Terms, protect users, address safety or fraud concerns, or comply with law.

3. Vendor eligibility and verification

Survdd currently supports Food Truck and Home-Based Food Vendor accounts in its Mobile, Alabama pilot. A vendor storefront is not eligible to accept orders until Survdd approves the vendor’s compliance submission and the vendor completes required payout onboarding. Survdd verification is an internal marketplace review; it is not a government inspection, legal opinion, food-quality certification, or promise that the vendor will remain compliant.

4. Menus, drops, schedules, and live locations

Vendor-provided menu descriptions, ingredients, prices, allergens, photos, inventory, preparation times, fulfillment windows, schedules, and location information are the vendor’s responsibility. Food-truck live locations expire automatically and should be posted only while the truck is actually serving or accepting orders there. Inventory controls reduce overselling risk but cannot guarantee availability in every technical or operational circumstance.

5. Orders and payment

A customer order is with the vendor identified at checkout. Survdd may temporarily reserve finite inventory while payment is pending. Unpaid reservations may expire and be released. Payments are processed by Stripe or another disclosed payment provider. The Survdd application is not designed to store complete card numbers or bank-account credentials.

Survdd’s standard launch commission is 10% of the food subtotal and is retained on the vendor side of a paid order. Survdd’s customer service fee is $0 at launch unless a different fee is clearly displayed before payment. Delivery fees, taxes, or other lawful charges may apply when shown at checkout.

6. Automatic vendor payouts

Survdd uses Stripe Connect to route vendor proceeds to eligible connected accounts. Stripe controls connected-account verification, payout timing, banking requirements, reserves, and payment-provider restrictions. A vendor that has not completed required payout setup cannot accept paid orders through the Platform.

7. Taxes

Transaction taxes may be calculated, collected, reported, or remitted by Survdd when applicable law requires Survdd to perform a marketplace-facilitator or similar function. Vendors remain responsible for their own tax registrations, returns, income reporting, and other obligations that are not legally assigned to Survdd. Tax treatment can depend on jurisdiction, seller status, product, and marketplace rules.

8. Fulfillment, cancellations, and refunds

Customers must provide accurate contact and delivery information and should arrive within communicated pickup windows. Vendors must fulfill accepted orders in accordance with the listing and applicable food-safety requirements. Ordinary order problems should be addressed with the vendor first. Customers may escalate an unresolved issue to Survdd. Survdd may issue a full or partial refund, credit, restriction, or other marketplace remedy based on the circumstances. 9. Food safety, allergens, and dietary information

Food information on Survdd is primarily vendor-provided. Survdd does not guarantee that an item is free from allergens or cross-contact, meets a medical diet, or is suitable for a particular person. Customers with allergies or dietary restrictions should review the listing and contact the vendor before ordering. Suspected food-safety problems should be reported promptly to Survdd and, when appropriate, to the relevant public-health authority.

10. Reviews and user content

Survdd limits reviews to completed paid orders when the transaction can be verified. Reviews and other content must reflect genuine experience and may not contain threats, unlawful content, private information, spam, impersonation, or knowingly false statements. By submitting content, you grant Survdd a non-exclusive license to host, display, format, and use it to operate and promote the Platform. Survdd may hide content that violates these Terms or creates a material legal or safety risk.

11. Prohibited conduct

You may not use Survdd to sell unlawful or prohibited products; evade permits or food-safety rules; manipulate reviews; commit payment fraud; scrape, attack, or reverse engineer the Platform except where law expressly permits; introduce malicious code; harass users; misrepresent credentials or locations; evade account restrictions; or interfere with Platform security or operation.

12. Intellectual property

Survdd and its original software, branding, interface, and content are protected by applicable intellectual-property laws. Vendors and users retain rights in content they lawfully own, subject to the licenses reasonably necessary for Survdd to display, process, and operate that content on the Platform.

13. Third-party services

The Platform may rely on Stripe, hosting providers, mapping/location services, email providers, and other third-party services. Their availability, terms, privacy practices, and operational requirements may apply separately. Survdd is not responsible for a third party’s independent service failure except to the extent required by law.

14. Service availability and disclaimers

The Platform is provided on an “as available” basis. To the maximum extent permitted by law, Survdd disclaims implied warranties not expressly stated here. Survdd does not guarantee uninterrupted service, minimum vendor sales, customer demand, food quality, regulatory approval, or the conduct of any user.

15. Limitation of liability

To the maximum extent permitted by law, Survdd and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Platform. A limitation that cannot lawfully apply will be enforced only to the extent permitted by law.

16. Indemnity

To the extent permitted by law, vendors agree to defend and indemnify Survdd from third-party claims arising from the vendor’s food, operations, permits, taxes, listings, fulfillment, infringement, or violation of law or the Vendor Agreement. Customers agree to be responsible for claims arising from their own misuse of the Platform or violation of these Terms.

17. Changes and termination

Survdd may change features or these Terms as the Platform develops. Material legal changes may require account holders to re-accept the updated terms before continuing. Users may stop using Survdd at any time. Transaction, safety, audit, accounting, tax, fraud-prevention, and dispute records may be retained when reasonably necessary or legally required.

18. Governing law and contact

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules, except where federal or non-waivable law applies. Legal questions or notices may be sent to legal@survdd.com.
